95.7 WAOR - America's First Classic Rock Station (the “Station”) is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. This Privacy Statement applies to the collection, use, and disclosure of personally identifiable information (“Personal Information”) for the Station’s web site, www.waor.com (“Web Site”), and offline services and activities, including Personal Information collected over the air, in-person at the Station, or on location. By using the Station’s Web Site, or participating in offline contests, sweepstakes or other activities, you consent to the information practices described in this Privacy Statement. The Station is owned by Pathfinder Communications Corp., (“Owner and Operator”), who also owns other radio stations, (“Station Affiliates”), WBYT-FM, Elkhart,  IN – WTRC-AM, Elkhart, IN – WNIL-AM, Niles, MI – WLEG-FM, Ligonier, IN – WBYR-FM, Van Wert, OH – WFWI-FM, Ft. Wayne, IN – WOWO-AM, Ft. Wayne, IN – WMEE-FM, Ft. Wayne, IN – WKJG-AM, Ft. Wayne, IN – JAM Communications (dba – WQHK-FM, Ft. Wayne, IN).

Your California Privacy Rights

If you are a resident of the State of California and you have registered on this Web Site or have provided your Personal Information to us, this section applies to you. You have a right to opt-out to our sharing of your Personal Information with “Station Affiliates” for marketing or promotional purposes, or to opt-in to sharing Personal Information with non-affiliated third parties for marketing or promotional purposes, such as our advertisers, promotional partners and sponsors (collectively, “Advertisers”). If you wish to know more about either of these options, please send your written request to WAOR Privacy Administrator or via our postal address below with the subject line “Your California Privacy Rights.” You must also provide your name, street address, city, state and zip code. We will not accept requests via telephone or by facsimile, or requests that are not complete or not labeled correctly. Please note that non-affiliated third parties are independent from our Station and Station Affiliates and if you wish to stop all communications from such third parties, you will need to make a request with the non-affiliated third parties directly. Collection of Your Personal Information

You are not required to provide Personal Information to access the Web Site. The Station collects Personal Information, such as your first and last name, email address, home or work address, city, state, zip code, gender, date of birth and/or telephone number for certain online activities such as our Preferred User loyalty club or Rock ‘N’ Rolodex email club. We also collect similar Personal Information plus employment history for employment purposes. The Station also collects anonymous demographic information, which may not be unique to you, such as your zip code, age, gender, preferences, interests and favorites. However, when this anonymous information is directly associated with or linked to your Personal Information or membership account, it is considered Personal Information. We may, however, feature certain activities such as surveys or voting activities that we will only ask for a zip code or date of birth, which will not be associated with or linked to your Personal Information. We will also collect certain forms of Personal Information offline that are sensitive or confidential in nature, such as social security number or driver’s license account number (“Sensitive Personal Information”) to conduct an employment or business transaction with you, including proof of identification as a winner of a contest or sweepstakes, for prize fulfillment, or to comply with federal and/or state laws. Credit card account numbers are also classified as Sensitive Personal Information and if you purchase goods or services on the Web Site, your payment transaction will be handled by an independent third party payment processor such as Pay Pal or Google Checkout payment services. The Station does not collect or have access to your credit card account information.

Information about your computer hardware and software is automatically collected by the Station. This information can include: your IP address, browser type, domain names, access times and referring web site addresses. This information is used for the operation of the Web Site, to maintain quality of the services and activities provided, to customize your online experience, and to provide general statistics regarding your use of the Web Site. We may share this information in the aggregate with Advertisers or other third parties; however, this information does not include Personal Information or by itself identify an individual user.

The Station may merge Personal Information collected offline with information collected online, or with information received from other sources such as credit bureaus, marketing companies, or public resources.

Please keep in mind that if you directly disclose Personal Information or Sensitive Personal Information, through the Web Site’s public message boards, blogs, submission of user generated content, or any other public venue, this information may be collected and used by others. For your convenience and information, the Web Site will link to other web sites. The Station encourages you to review the privacy statements of web sites you choose to link to from the Web Site so that you can understand how those web sites collect, use and share your information. The Station is not responsible for the privacy statements, other content or business practices of web sites outside of the Station or Station Affiliates’ family of Web Sites.

Collection and Use of Personal Information From or About Children

We recognize the importance of protecting the privacy of children and are committed to protecting children’s privacy on the Internet. We comply fully with the Children’s Online Privacy Protection Act (“COPPA”). We do not generally target children for our activities and services and do not knowingly collect Personal Information from children under the age of 13, except as discussed below. If we discover that a child under the age of 13 has provided Personal Information to us that does not qualify for any regulatory, legal, or security/safety exemption as described below, or we are contacted by a verifiable parent or legal guardian about his or her child’s participation on our Web Site, we will delete the Personal Information about the child from our active records and from our systems to the extent technically feasible.

We are required by federal law to place all correspondence from the public related to a broadcast station’s operations or programming in the Station’s FCC Public Inspection File, made available via electronic access at the Station or posted electronically online. If we know that email or other correspondence is from a child, we cannot delete the correspondence but we reserve the discretion to remove any Personal Information that could be used to contact the child from the correspondence before placing it in the FCC Public Inspection File or made available to the public.

On occasion, our Web Site may enable parents or legal guardians to submit information about their child under the age of 13 for purposes of participating in programs or activities, such as photo galleries and contests/sweepstakes. In such instances, we only request the types of Personal Information necessary for participation in the program or activity, which may include, but is not limited to, the parent’s name and email address, child’s name, age, city, and a photograph of the child. This information would be used only for purposes of the specific program or activity.

Use and Disclosure of Your Personal Information

95.7 WAOR - America's First Classic Rock Station collects and uses your Personal Information to operate the Web Site and deliver the online and offline services you have requested. We also use your Personal Information to inform you of other products or services available from the Station, Station Affiliates, and our Advertisers. The Station may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

95.7 WAOR - America's First Classic Rock Station does not sell, rent or lease Personal Information to unaffiliated third parties for marketing or advertising purposes, unless you first provide your affirmative consent to do so, also known as an opt-in. The Station may, from time to time, contact you on behalf of our Advertisers about a particular offering that may be of interest to you. In those cases, your Personal Information is not transferred or disclosed to the Advertiser. We will also share your Personal Information at the corporate level and within the family of Station Affiliates for business, marketing and advertising purposes. In addition, the Station may share Personal Information with trusted partners or vendors (“Operational Service Providers”) to help us perform statistical analysis, send you email or postal mail, provide customer support, arrange for deliveries or prize fulfillment, or provide another service or function. All such Operational Service Providers are prohibited from using your Personal Information except to provide these services to the Station, and they are required to maintain the security and confidentiality of your information.

The Station does not use or disclose Sensitive Personal Information without your explicit consent, unless such disclosure meets one of the following exceptions. The Station will disclose your Personal Information or Sensitive Personal Information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with statutory and regulatory requirements, requests by governmental authorities, or with legal process or court orders served on the Station; (b) protect and defend the rights or property of the Station or our users, including enforcement of our Terms of Use Agreement and security of the Web Site; (c) protect the personal safety or health of Station employees, users , or the public; and (d) to transfer, merge, sell, or reorganize all or part of the assets or shares of the Station or its Owner and Operator.

We will retain your Personal Information as long as you are a registered user of the Web Site or until it is no longer needed for legal, regulatory, or business purposes.

If you wish to opt-out of the Station’s disclosure of your Personal Information to Station Affiliates for marketing and advertising purposes, please contact our Privacy Administrator. You may also opt-out of receiving emails that are sent for marketing or advertising purposes or terminate your Preferred User or email club membership by unsubscribing according to the instructions in the email, or by contacting our Privacy Administrator. Please note that we will continue to send you emails for business and transactional purposes, such as contest notification or fulfillment or information related to your purchases.

Use of Cookies and Other Standard Internet Tools

The Web Site may use cookies, web beacons and other standard Internet tools to help you personalize your online experience. A cookie is a text file that is placed on your hard disk/browser by a web page server. A web beacon is a small graphic image (often invisible) that works with cookies to customize your online experience by monitoring your use of web pages, email messages or online activities and features of this Web Site, including advertisements. Cookies, web beacons or other such tools cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies, web beacons and other such tools is to provide a convenience feature to save you time and customize your online experience. For example, if you register with the Web Site or services, a cookie helps us to recall your specific information on subsequent visits. When you return to the Web Site, the information you previously provided can be retrieved, so you can easily use the features that you have customized.

The Station does not control or have access to the use of such cookies, web beacons, or tools used by Advertisers. We only have control of the cookies, web beacons, or other tools that we use or place on your browser.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. Please check your browser “Help” menu. If you choose to decline cookies, you may not be able to fully view or experience the interactive services and features of the Web Site or other web sites you visit.

Security of Your Personal Information

95.7 WAOR - America's First Classic Rock Station reasonably secures your Personal Information from unauthorized access, use or disclosure. The Station secures the Personal Information you provide on computer servers in a reasonable controlled, secure environment, protected from unauthorized access, use or disclosure. We also take reasonable measures to secure the Personal Information and Sensitive Personal Information we collect offline. We traditionally collect Sensitive Personal Information only offline but if we will collect such information via the Web Site, it will be done in a reasonably secure manner using encryption and other industry standard measures in accordance with law. However, please be aware that no Personal Information is guaranteed to be secure.

Changes to this Privacy Statement

The Station will occasionally update this Privacy Statement to reflect company and customer feedback, changes to the features, activities, and services we provide, or changes in our business practices. You are encouraged to periodically review this Privacy Statement to be informed of how the Station will use, disclose and protect your information. When we make material changes to this Privacy Statement that directly affect how your Personal Information is collected, used, or disclosed, we will also post a notice on the Web Site’s homepage and/or send you an email.
